‘Halt issuing licence to networking businesses’

KATHMANDU, JULY 31

The Industry, Commerce, Labour and Consumer Welfare Committee of the Parliament today directed the government to halt issuing licences to multi-level marketing businesses, popularly known as networking businesses.

The committee also directed the government to submit the details of companies that have acquired licences to operate multi-level marketing businesses, details of their promoters, different directives issued by the government to allow operation of such businesses, details of networking businesses and their owners who had cheated customers in the past and other related documents within three days.

The recent decision of the Department of Commerce, Supplies and Consumer Protection Management (DoCSCPM) to issue multi-level marketing business licence to various firms has been criticised by different quarters, especially consumer rights activists citing that such firms had massively cheated customers in the past and those acquiring licences for networking businesses were among those who were involved in cheating customers in the past.

Of late, the department had issued multi-level marketing business licences to firms, including iboss Global International, Nature Herbs International, New Bibek Enterprises, Healthy Living Nepal, Care Matters International, Uturn International and Global Orients Nepal.

Consumer rights activist Madhav Timalsina said that those acquiring new licences were among those who had cheated customers in the past.

“The same old people have been found to be taking licences in the name of direct sales of commodities.

As we have a bitter experience of such networking businesses in the past, the government should be careful while issuing such licences.

Moreover, licences should be issued only after bringing in necessary policies to regulate such business,” he mentioned.

Different firms including Herbo International, Unity Life International, Crystal Vision International and Best World Business Link, among others were found cheating customers of billions of rupees in the name of networking business. Moreover, customers of these firms, including that of Unity Life, are yet to receive compensation from the government.

However, the department has been defending its decision to issue such licences citing that licences were issued under the Direct Sales Commodity Act.

Meanwhile, the House panel has also formed a subcommittee under the coordination of lawmaker Som Prasad Pandey to conduct a study on the networking business and recommend effective policies to regulate it.

The committee comprises lawmakers Krishna Kumar Shrestha, Amrita Agrahari, Prakash Rasaili and Sarita Giri as members. The committee has been given 15 days to carry out the study and submit its report.

The House panel today had summoned Commerce Secretary Baikuntha Aryal and DoCSCPM’s Director General Netra Prasad Subedi for discussions.

One-way traffic resumed on Prithvi Highway after landslilde in Tanahun 

KATHMANDU: One-way traffic has been opened as landslide debris have partly been removed at Aanbukhaireni Rural Municipality-2 along the Prithvi Highway in Tanahun district.

The traffic on the road section had come to halt due to the landslide that took place at Ainapahara in Anbukhaireni 2 this morning, police said. Meanwhile, one-way traffic has been resumed after partly removing debris from Aanbukhaireni-Muglin road section, according to spokesperson at Tanahun District Police Office, Deputy Superintendent of Police (DSP) Yubaraj Timilsena.

Efforts are on to clear the landslide debris for regular two-way traffic, police informed.

Over 40 houses inundated in Bara

BARA, JULY 31

Monsoon rain has inundated more than 40 houses due to negligence during the construction of Manmat-Kaliaya Postal Highway, at Shreepur village of Kalaiya Sub-metropolitan City, Bara. The rainwater has also submerged dozens of houses, including saw mills at Bhawanipur of the sub-metropolis.

Lives of 40 families have been hit very hard at Shreepur village due to inundation and other monsoon related disasters. Locals said failure to install a drainage while extending and black-topping the road had caused the problem.

They complained that the local government had not heeded their requests.

Prior to the road expansion, a hume pipe was installed to drain out the water near local school at Shreepur village. A local Hiralal Chaudhary said DS Construction Hetauda and its technicians had removed the hume pipe while extending the road.

“Due to incessant rainfall and inundation, more than two dozen families have been taking shelter in the houses of other people. Water level in the area is still above the knee. We have to wade through the water-logged road to get home. We fear snakes as they come out due to the rainwater,” said another local, Nandalal Chaudhary.

Inundation has adversely affected more than 40 families. Locals had demanded removal of the hume pipes and construction of a culvert.

Inundation has damaged electric machinery worth millions in the saw mills, said Shami Saw Mill proprietor Narayan Prasad Sah. Rainwater has submerged Gadhimai Saw Mill, Hridaya Saw Mill and Ashiya Saw Mill. Sah complained that hundreds of families were rendered homeless as mayor, deputy mayor and CDO turned a blind eye to their problems.

“Rainwater has inundated many houses,” said Sah.

Lockdown relief for tenants

KATHMANDU, JULY 31

The Supreme Court has issued an interim order telling the government to ensure that no landlord evicts a tenant for failing to pay rent in the face of coronavirus pandemic.

A division bench of justices Tej Bahadur KC and Kumar Regmi issued the order in response to a writ petition filed by Central Chair of OBC Federation Gajendra Thakur and others against the Office of the Prime Minister and Council of Ministers.

The court observed that the issue of rent was a matter to be settled between tenants and landlords on the basis of their mutual understanding, consent and humane thinking and the government should ensure that tenants were not evicted from their rented place just because they had not been able to pay rent for the lockdown period. The SC also ordered the government to ensure that no tenant was subjected to mistreatment by landlords for not being able to pay rent for the lockdown period.

The apex court also asked the government to tell local bodies to monitor and supervise the court’s order. The court observed that the government should not deny anybody relief announced during lockdown just because somebody does not have a receipt of house rent.

The petitioner had urged the court to issue an interim order to landlords telling them not to seek rent from hair salon operators since they had been barred for operating since the lockdown was imposed. The government had imposed lockdown on March 24 and lifted it on July 21 with some restrictions.

The apex court observed that it did not need to issue an interim order telling landlords not to seek rent from hair salon operators for the lockdown period as the issue would be addressed in the final hearing of the case.

Countries should gradually lift international travel measures based on a thorough risk assessment and must prioritise essential travel for emergencies, the World Health Organization (WHO) said on Thursday.

The WHO recommended that priority should be given to essential travel for emergencies, humanitarian actions, travel of essential personnel, and repatriation.

A surge of new infections in many parts of the world has forced many countries to reimpose some travel restrictions.

The WHO has now urged each country to conduct a risk-benefit analysis of its own and decide on its priorities, before resuming international travel.

In its latest travel advisory, the WHO said countries must take into account the local epidemiology and transmission patterns, the national health and social measures already in place.

Should countries choose to quarantine all travellers on arrival, they must do so after assessing such risks and consider local circumstances, WHO said. There is no “zero risk” when considering the potential importation or exportation of cases in international travel.

Earlier this week, the WHO said that bans on international travel cannot stay in place indefinitely, and countries are going to have to do more to reduce the spread of the novel coronavirus within their borders.

It said last month that it would update its travel guidelines ahead of the northern hemisphere summer holidays.

Earlier in July, it urged travellers to wear masks on planes and keep themselves informed as COVID-19 cases surge again in some countries.

The WHO’s previous guidance for travellers has included common-sense advice applicable to other settings such as social distancing, washing your hands and avoiding touching your eyes, nose or mouth.

Minister highlights Padmasambhava Circuit

Minister of Culture, Tourism and Civil Aviation Yogesh Kumar Bhattarai said Padmasambhava Circuit would be a milestone for the development of tourism industry in the country.

In a discussion program held at the Ministry of Culture, Tourism and Civil Aviation with stakeholders and office-bearers of Barbara Foundation on the development of Padmasambhava Circuit, Minister Bhattarai said the circuit was connected with the Buddhist philosophy and had cultural and religious significance.

Bhattarai expressed confidence that the circuit would help attract many Tibetan and Chinese religious tourists and would help to lengthen their stay. He said the government had allocated budget for the development of the circuit in the new fiscal year. He also instructed the concerned department under his ministry to prepare a DPR for the same. Claiming that the circuit would be developed as an international cultural hub, he said, “Padmasambhava, a key religious leader to propagate Buddhism, had travelled to various places across Nepal. Those places could be developed as tourism centres.”

Director General of the Department of Archeology, Damodar Gautam said Padmasambhava, usually referred to as Guru Rinpoche, had arrived Nepal from Takshashila, in the eighth century for penance. Tibetan king of the era had invited him to Tibet to propagate Buddhism there, said Gautam. Also speaking in the discussion, Lumbini Buddhist University Prof Ramesh Kumar Dungel said Padmasambhava Circuit would contribute to promote international cultural tourism.

Lumbini Development Trust’s Vice-president Abadhesh Tripathi and Buddhist Philosophy Promotion and Monastery Development Committee Chairperson Phupuchembe Sherpa Jikdol said Padmasambhava Circuit should be developed as an important tourism product.

Nepal to reopen Everest to climbers despite coronavirus case rise

Nepal will reopen its Himalayan mountains including Mount Everest to climbers for the autumn season, officials said today, to boost the tourism-dependent economy despite rising coronavirus infections.

Home to eight of the world’s 14 tallest mountains, Nepal shut down climbing and trekking in March to stem the novel coronavirus, which has so far infected 19,547 people and caused 52 deaths in the country of 30 million.

“We have reopened mountaineering and will issue climbing permits for the autumn season,” tourism department official Mira Acharya said, adding that climbers must follow health protocols issued by the government. The autumn climbing season in Nepal runs from September to November. While infections in many western nations are falling, South Asian countries including Nepal are still witnessing a steady rise in the caseload.

The absence of climbing in the popular April-May season caused Nepal millions of dollars in losses. Hundreds of foreign travellers and some 200,000 sherpas, guides and porters were hit.

Though the government now wants to reopen climbing, international flights are shut until mid-August and travel restrictions within Nepal remain, meaning climbers will still be kept away in the short term, expedition organisers said.

“Some climbers to smaller mountains may come but I have doubts about big ones,” said Ang Tshering Sherpa, an expedition organiser in the capital Kathmandu.

Nepal today also allowed the reopening of hotels and restaurants with some restrictions. No conferences, seminars, gyms or casinos would be allowed, said Binayak Shah, vice president of the Hotel Association Nepal. “Now it is (about) which hotel is safe, not which offers better services,” Shah said.

Hotels, restaurants start resuming services

Hotels and restaurants, that had remained closed for the past four months due to the lockdown, have resumed their business from today.

The government had decided to resume hotel business from July 30 after the four month-long lockdown. Offices related to trekking, travel and mountaineering have come into operation in view of tourism season. Tourism entrepreneurs plan to take the business ahead by following health protocol with new enthusiasm after the end of lockdown.

First Vice-chairperson of Hotel Association of Nepal, Binayak Shah, said the dilemma persisted about issues like whether or not foreign tourists visiting Nepal have to stay in quarantine. There is still a slim chance of foreign tourists visiting Nepal any time soon. Tourism entrepreneurs said that they were ready to welcome tourists. They also said they would be able to uplift their business to some extent, pinning their hope on domestic tourists and that it would take some time for the business to return to normalcy.

Hotel entrepreneurs are planning to bring only 10 per cent of the total capacity of a hotel into operation at the initial phase.

Hotel entrepreneurs said they have resumed their business only with the intention to create an environment conducive to run business rather than making profit. The government has decided to resume domestic and international flights from August 17.

Paudel, Koirala ask Deuba to play fair

Kathmandu, July 30

Senior leader of Nepali Congress Ram Chandra Paudel and party General Secretary Shashank Koirala today wrote a joint letter to the party President Sher Bahadur Deuba, saying they had lost confidence that the upcoming 14th National Convention of the party would be held in a free, fair and impartial manner.

The leaders organised a press conference after submitting their memorandum to the president at the party office. They said it was important for the party to distribute active membership in a transparent manner and carry out its activities as per the party statute and rules.

They said all party bodies, including President Deuba had become caretaker office bearers as the tenure of the current leadership and all party bodies had already ended in mid-March. Paudel and Koirala also opposed formation of some party departments arguing that as per the party statute, Deuba was supposed to form all departments of the party within six months, but he has been forming the departments even after the end of the tenure of the central leadership. Recently, Deuba had nominated office bearers in some party bodies and had also formed the Senior Politicians’ Assembly.

Paudel and Koirala accused Deuba of forming party departments to influence the result of the upcoming national convention in his favour. They reminded Deuba of the dissolution of the party departments by former president Sushil Koirala after Deuba opposed the formation of the departments in the third year of Koirala’s four year tenure. They wrote in their letter that formation of party departments, nomination of office bearers and creation of posts in party bodies at a time when the date for the next National Convention has already been fixed, was a violation of party statute.

They said the party had been distributing active membership to party cadres in some districts, but in other districts the party had not been distributing active membership to the deserving candidates. They also demanded that all NC diaspora organisations should hold their conventions before they could be eligible to be elected as National Convention representatives. They also demanded that all bodies of the party should hold their conventions without further delay.

Nepal asserts claim over Kalapani

KATHMANDU, JULY 29

Darchula District Administration Office has written a letter to Indian authorities in Dharchula, Uttarakhand, stating that Limpiyadhura, Lipulekh and Kalapani are Nepal’s territories as per Article 5 of Sugauli Treaty, maps and historical facts and evidences.

The letter adds that it was natural for Nepalis to go to these areas.

Chief District Officer of Darchula district Sharad Kumar Pokharel told THT that he wrote to Indian authorities asking them not to create obstruction in Nepalis’ movement into these areas in response to Indian authorities letter to his office.

India’s Dharchula Sub-district official Anil Kumar Shukla had sent an e-mail to Darchula DAO on July 14, calling for an end to ‘illegal’ entry of Nepalis into the territories.

Stating that such ‘illegal’ crossing of the border would create problems for administrations of both countries, Shukla had urged the Nepali side to stop ‘illegal’ crossings and inform the Indian side about any such activity.

Supreme Court rejects plea to halt compensation hearing

KATHMANDU, JULY 29

The Supreme Court has rejected US-Bangla Airlines’ request to halt the hearing of a case filed by the families of seven deceased passengers who were all pursuing their MBBS in Bangladesh. After the hearing of both sides on Sunday, the apex court stated that no such interim order could be issued in the ongoing case.

A division bench of Chief Judge Bishowambhar Prasad Shrestha and Judge Purushottam Bhandari issued the decision, observing that halting the hearing of such a sensitive case, which was under consideration at the district court, would be unjustifiable.

Moreover, such a decision might affect the families of victims, forcing the apex court to reject the company’s demand to halt the case, said Bidur Man Shrestha, father of one of the deceased students.

According to him, they received the SC order today and came to know that the apex court had called for another hearing on August 25.

The 12 March 2018 flight from Dhaka crash-landed at Kathmandu airport and skidded off the runway before bursting into flames, killing 51 people in the deadliest aviation accident in the country in decades. Twenty-eight of the deceased were from Bangladesh, 22 from Nepal and one from China.

Families of seven Nepali passengers had filed a writ at the SC seeking insurance claim. However, the airline company, insurance company Sena Kalyan Insurance Ltd Bangladesh and reinsurer Sadharan Beema Corporation had asked the apex court to halt the case, arguing that victims cannot file a case in Nepal.

However, Kathmandu District Court issued an order on December 5, stating that victims’ families can process for compensation from Nepal.

On 11 March 2019, Patan High Court had ruled that Kathmandu District Court had the jurisdiction to adjudicate the compensation case filed by families of victims of US-Bangla Air crash.

Victims’ families have demanded Rs 2.10 billion compensation based on Montreal Convention-1999 and Warsaw Convention-1929, according to plaintiffs’ advocate Amrit Kharel.

Families of late Ashna Shakya, Anjila Shrestha, Meeli Maharjan, Neega Maharjan, Princy Dhami, Sanjaya Maharjan and Shreya Jha had filed a joint lawsuit against the company.
