Editorial: Airfare dilemma

The government’s bid to push for uniform airfares for both locals and foreigners has seen mixed reaction, with the domestic airline operators terming it as impractical and the tourism entrepreneurs largely welcoming it.

The plan has been floated by Yogesh Bhattarai, who just took over as tourism minister on July 31. The government’s move to apply uniform rates for all types of passengers comes on the eve of Visit Nepal Year 2020, when the country is hoping to bring in 2 million tourists. Until now, airlines have been charging two sets of airfares for locals and foreigners, with the air operators setting the fare for Nepalis as per the base rate set by the government. Foreigners are charged more, and the airlines make a good profit, especially on routes that see heavy tourist traffic, such as Lukla, Pokhara and Chitwan, and on mountain flights.

The logic for applying uniform airfares, as given by those in the tour and travel industry, is that Nepal is the only country that sets different rates for travel and accommodation for locals and foreigners. This, according to them, has made Nepal a comparatively expensive destination and is dissuading foreigners from revisiting the country. The case against it is that Nepal might have to revise its charges in other sectors, such as mountaineering, where there is differentiation in the royalty charged.

It is not difficult to conjure up what will happen if the tourism minister has his way with the airfare. The fare can either come down to the level enjoyed by the Nepali passengers or go up to the one being charged for foreigners. In all likelihood, it will be a compromise between the two. This may cheer the foreigners, but will see widespread opposition from the Nepali passengers, many of whom rely on airplanes to ferry them to the remote destinations still untouched by roads. The fares for the locals, though cheaper, are still expensive for them, but still a flight is the only resort in times of an emergency, such as a medical complication. It is apparent that the idea has been floated without doing the necessary homework and holding discussion with all the stakeholders, including the ordinary Nepalies, who make up the bulk of passengers on domestic routes.

The tourism minister must be in a dilemma as to the course of action to take. Complaints have been heard from foreigners time and again as to why they should be charged more for a seat in a plane or bus when travelling with the Nepalis. Seemingly, it seems unjustifiable in having separate fares for separate people when they are receiving the same service. If such measures are indeed discouraging a visitor from coming to Nepal, then they must be corrected. Why should a foreigner walking into a restaurant pay a lot more than what the locals pay for a coffee or a bottle of beer or while taking a bus ride to, say, Pokhara or while buying a ticket to watch a football match? Nepal’s endeavour to lure more foreign tourists by cutting down on visa fees or providing visa on arrival has not helped tourist spending in Nepal. Actually, it was a dismal $ 44 a day in 2018, down from $ 54 a year earlier.

So rather than numbers, both the government and the tourism entrepreneurs should be chasing affluent tourists who are willing to spend more than the Nepalis.


Consumer rights

The constitution has guaranteed the citizens consumer rights, under which they are entitled to standard services from the service providers and quality goods from the traders and sellers. But this provision has been found grossly misused by both. The consumers do not have any knowledge about where they should lodge their complaints when they are denied standard services and goods in the market. According to the Consumer Protection Act-2019, an offender is to be punished with a fine ranging from Rs 200,000 to Rs 300,000 if s/he is found guilty of flouting the rules. Consumers are largely cheated by the traders, especially during the festive seasons though the government bodies launch an inspection of the groceries.

An annual report of Province 3 issued by the National Human Rights Commission has revealed that many people do not know how to file a complaint against fraudulent traders. The report calls on the concerned authorities to launch awareness campaigns about the legal provision and the process of filing complaints against such traders. It is the duty of the government to launch market monitoring round the year.

Victims’ woes unaddressed

• INTERNATIONAL DAY OF THE DISAPPEARED

The Supreme Court’s landmark verdict in June 2007 directing the government to take measures to address the grievances of victims of conflict-era disappearances continues to remain elusive.

The SC had directed the government to ensure accountability for disappearances, establish a commission of inquiry consistent with international standards, criminalise enforced disappearances, investigate and prosecute persons responsible for disappearances and provide adequate compensation and relief to victims and their families.

Similarly, international organisations had also urged the government to investigate cases of enforced disappearances, provide adequate compensation to victims and their families and enact laws in line with international standards and Supreme Court verdicts.

However, the government has neither implemented Supreme Court verdicts nor has it bothered to heed international organisations.

The government set up the Commission of Investigation on Enforced Disappeared Persons in 2015. The commission collected 3,212 complaints of conflict-era enforced disappearances. However, it failed to investigate even a single case, thanks to lack of legislation, the state’s financial control over CIEDP and the commissioners’ loyalty to political parties.

As the world marks International Day of the Disappeared tomorrow, families of those who disappeared during the Maoist insurgency that lasted from 1996 to 2006 still continue their fight to know the whereabouts of their loved ones and grapple with various vulnerabilities and social stigma.

That fight has now shifted to the second generation in some cases. Nagma Mali of Thecho, Lalitpur, is a case in point. Nagma was seven years old when security forces picked up her father Nanda Gopal from Tahachal area in April 2004. Nagma and her younger sister, who had lost their mother at a very young age, also lost their grandfather Sanu to cancer a year after their father’s disappearance.

The two sisters were then raised by their grandmother Mishree, who also lost her life in January this year.“My grandmother fought for her entire life to know the whereabouts of her disappeared son,” said Nagma, now 22. “Now, I have taken up the baton.”

However, this is not the only front Nagma is fighting on. She is also fighting a court battle against her father’s cousins who tried to grab her grandfather’s property after his death although her father was the only son of his parents and he should have inherited Sanu’s property.

After Nanda Gopal disappeared, the property should have ideally been transferred to Nagma and her sister. But as per the law, Nagma needed to produce their father’s death certificate.

Although, the kin can acquire death certificate 12 years after the disappearance, Nagma does not want to do so.“How can I acquire death certificate of my father when the state has not said he is dead?” Sanu asked. “So my father’s cousins are trying to exploit my compulsion and grab our property.”

This is a common problem faced by the victims as male heads of family who control family property have been disappeared in majority of cases. This has also led to the family losing guardianship and struggling financially.

“There’s not a single day when I do not miss my father,” said Nagma. “But I miss him the most when I am not able to pursue things I like in the absence of a guardian who could have supported me morally and financially.”

Nagma represents victims based in urban areas who have somewhat better access, but things are worse when it comes to those who are based in remote areas.
Such victims, who make up more than 45 per cent, have not even received government relief and do not know whether an inquiry commission has been established, according to Bishnu Pathak, former member of CIEDP that conducted
preliminary investigation into complaints in around 60 districts.

“They are so naive they just want to know the truth and conduct the final rites of their loved ones,” said Pathak. “Women are the most affected in rural areas because of the associated social stigma,” he said.

Pathak said the problem could not be solved without strong political will.
Victims’ families also say the issue could be resolved only if the state implemented the Supreme Court’s verdicts, fulfilled social, political and economic needs of the victims, told victims the truth and guaranteed non-repetition of conflict.

“The solution lies at the local level,” said Ram Kumar Bhandari, founder of National Network of Families of Disappeared and Missing Nepal. “But strong political will is needed.”

Editorial: Decks cleared for NIC

One year after the government started distributing the National Identity Card (NIC), also known as a biometric card, the federal Parliament has just passed a bill to this effect.

The House of Representatives (HoR) endorsed the National Identity Card and Civil Registration Bill after the parliamentary State Affairs and Good Governance Committee unanimously endorsed it two weeks ago. Home Minister Ram Bahadur Thapa had initiated the distribution of the NIC amidst a function in Phidim Municipality on November 19 last year.

Bhagawati Devi Bhandari, 101, of the municipality was the first person to receive the card. Home Minister Thapa was the second person to receive the card from centenarian Bhandari. But the government had to stop distributing the NIC after the main opposition, the Nepali Congress, questioned why the NIC card was being distributed when there was no law governing it. The National Identity Card Management Centre (NICMC) had collected details of a total of 52,754 people from Panchthar district and 3,500 government employees from Singha Durbar for the card. Earlier, the government had decided to distribute the NIC to 117,000 individuals in the first phase as a pilot project. According to the NICMC, they were supposed to distribute the NIC in 15 districts, including Jhapa and Sankhuwasabha of Province 1, Mahottari and Saptari of Province 2, Lalitpur, Chitwan and Rasuwa of Province 3, Tanahun and Syangja of Gandaki Province, and Kanchanpur and Achham of Sudurpaschim Province during the last fiscal.

The centre has set the target of distributing the NIC to every citizen within three years. The bill contains vital information of a citizen, including biometric data. The bill will be forwarded to the National Assembly for its approval, and it will become law following the president’s authentication. The NIC will have two sets of information for Nepali citizens – information on the card outside and information inside the card’s chip. The card will include the name of the citizen, his/her family name, date of birth, gender, nationality, ID card number, photo, issued date, name and signature of issuing authority, permanent address, type of citizenship card and citizenship card number. The information stored in the electronic chip installed inside the card will also include the same information besides biometric information, names of the parents and grandparents. Persons who have obtained Nepali citizenship paper and those who are eligible for the citizenship paper can apply for the NIC.

The bill has also proposed issuing different identity cards to foreigners and Non-Resident Nepalis (NRN). The government will issue general and biometric cards to foreigners working in diplomatic missions and tourists and NRNs. Addressing the HoR, the home minister said once the general and biometric card comes into full operation, the existing citizenship certificate could be phased out gradually. The government will have a centralised database of all the citizens. And chances of obtaining a fake citizenship paper will be lessened to a great extent. The NIC should also be allowed for voting purpose as it will reduce the management cost of the three tiers of elections. However, protecting the national database from its misuse is a big challenge.

Uniformity in airfare infeasible: Operators

Kathmandu, August 28

The government’s plan to implement uniformity in airfare for locals and foreigners is not flying high with airline operators, who have slammed the move as ‘infeasible’.
After Tourism Minister Yogesh Bhattarai announced plans to bring uniformity in airfare, the Airline Operators Association of Nepal sent a letter to the Ministry of Culture, Tourism and Civil Aviation today evening expressing strong reservations against the move.

“The minister should have conducted a market study before floating the idea of revising the airfare,” said Pabitra Karki, president of AOAN, adding it was infeasible to charge the same rate for both domestic and foreign passengers.

According to him, domestic airline operators have set the airfare for locals in accordance with the base rate set by the government. Saying the minister’s announcement had blind-sided airline operators, he informed, “We have provided all the details on the airfare and urged the ministry not to take a decision that would be a death knell for private domestic airlines.”

Karki further questioned the rationale behind planning to impose uniformity in airfare when the government had set different rates for local and foreign climbers for mountaineering. He also said setting separate airfare rates for locals and foreigners was an international practice.

However, Achyut Sharma Guragain, first vice-president of Nepal Association of Tour and Travel Agents, refuted Karki’s claim. “No other country sets different rates — whether for travel or accommodation — for locals and foreigners,” he said. “This has made Nepal a comparatively expensive destination and is dissuading foreigners from revisiting the country.”

Meanwhile, Ghanashyam Upadhyaya, spokesperson for MoCTCA, said the minister had just floated the idea of bringing uniformity in airfare and assured that the ministry would hold discussions with all concerned stakeholders before implementing any decision.“There is no need to panic,” he said.

Tourism entrepreneurs, however, believe that if the government implements uniformity in airfare, it will provide a major boost to the tourism sector. “The government should seriously consider acting on this plan, especially considering the Visit Nepal Year 2020,” said Guragain.

SC rules in Ncell’s favour

The Supreme Court gave a ruling in Ncell’s favour in a case filed by the private telecom against Large Taxpayers’ Office for imposing Rs 62.63 billion as applicable capital gains tax on Ncell for its buyout deal.

A grand full bench of the apex court said that Ncell could be expected to fulfil its CGT liability from 6 February 2019 when the SC gave the ruling and not the date the LTO used to impose CGT on Ncell.

A source at the SC said that the SC quashed LTO’s decision to impose fine on Ncell, which means that the private telecom firm would now have to pay only around Rs 22 billion, including some late fees.

The SC also quashed LTO’s decision to impose fine on Ncell as per section 120 (a) of Income Tax Act 2002, which allows the LTO to impose fine equal to fifty per cent of the amount that the concerned company failed to reveal in the document.

“Today’s verdict means that  Ncell needs to pay a total of around Rs 45 billion CGT since it has already paid around Rs 23 billion, it will now have to pay only Rs 22 billion more,” the source added.

The apex court observed that the LTO had determined Rs 143 billion as gains in the Ncell buyout deal, which the SC also had accepted. “But if the LTO finds evidence of more taxable income, then it is free to impose more tax on the telecom firm,” the SC said in its verdict.

The court said that the LTO’s decision to impose fine on Ncell was wrong as it imposed fine without any solid evidence, the SC source added.

The apex court said that the LTO, while determining CGT for Ncell, did not allow it to furnish details of its transactions and buyout.

The LTO had officially determined Rs 62.63 billion as applicable CGT on the Ncell buyout deal on April 16 and had ordered the private telecom firm to deposit Rs 39.06 billion, as the firm had already deposited Rs 23.57 billion as CGT and late fee. The LTO levied CGT on Ncell from the date the Ncell buyout took place. Axiata Group Berhad, through its wholly-owned subsidiary Axiata Investments (UK) Ltd, had bought 80 per cent stake in Ncell for $1.4 billion in December 2015.

Ncell moved the SC on April 22  against the LTO, claiming that it needed to pay a capital gains tax of only Rs 14.5 billion for the sale of its shares to Axiata Investment UK Ltd.

Following this, the SC had stayed the LTO’s decision to collect Rs 39.06 billion tax from Ncell.

Ncell’s parent company Axiata Group (UK) has submitted a request for arbitration with the ICSID against the Government of Nepal, for levying CGT on the Ncell buyout deal saying Nepal’s conduct was in contravention of its international law obligations under the bilateral investment treaty.

Ncell had argued that LTO should not have levied tax on Ncell for the period preceding February 6, the day the SC decided that CGT liability rested with Ncell and not TeliaSonera.

Ncell also argued that the SC, in its February 6 decision, did not order Ncell to pay any fees or interests. The SC is yet to prepare the full texts of the verdict.

The order was passed by a full bench consisting of justices Tej Bahadur KC, Purushottam Bhandari, Dambar Bahadur Shahi, Sushmalata Mathema and Manoj Kumar Sharma.

Aguero strikes again as City win at Cherries

BOURNEMOUTH: Sergio Aguero struck twice as Manchester City moved into second place in the Premier League, two points behind leaders Liverpool, with a 3-1 win at Bournemouth on Sunday.

Just three weeks into the new season and last year’s top two clubs are already perched at the top of the table. While City‘s draw at home to Tottenham Hotspur last week has given the edge to Juergen Klopp’s side, City again look deadly in the final third.

City‘s all-time top scorer has now scored 400 goals for his clubs and country and the 31-year-old Aguero shows no signs of easing up.

Despite the sharpness in the box, City manager Pep Guardiola was not satisfied with the performance and credited Bournemouth’s tactics.

“We weren’t at our best, but knowing the conditions, the way they defend, they don’t press, they wait, sit back, wait for the counter attack, so there wasn’t rhythm but we solved it,” said the Spaniard.

Aguero, who has scored in all three games this season, gave City a 15th-minute lead, slotting home after left back Oleksandr Zinchenko’s low cross had been mis-hit by Kevin De Bruyne only to fall kindly for the Argentine.

Bournemouth suffered a blow in the 32nd minute when their wing-back Charlie Daniels was carried off on a stretcher after suffering what looked like a recurrence of the knee injury which sidelined him in March.

Adam Smith then missed a great chance to level for the Cherries, firing high over the bar from a good position after some poor defending from Nicolas Otamendi.

Moments later Raheem Sterling doubled City‘s lead with a confident finish after David Silva concluded a sweeping move with a perfectly angled pass to the England striker.

But Bournemouth got back into the game in magnificent fashion, just before the interval, thanks to an unstoppable curling free-kick from substitute Harry Wilson, on loan from Liverpool.

Wilson went close to a leveller after the interval but Ederson was out quickly to foil his effort and City then made sure of the win when Aguero poked home his second goal in the 63rd minute, following in for the scraps after David Silva had surged into the box.

“It was a tough game, we knew it would be,” said Guardiola, “We have seven points. We should have nine, but it’s OK.”

Van Aanholt powered a shot past United keeper David De Gea after new signing Daniel James scored an 89th-minute equaliser to cancel out Jordan Ayew’s first-half opener for the visitors.

“We just were not clinical enough in front of goal and they scored two very easy goals,” Solskjaer told the BBC.

“I thought we got our act together second half, we just couldn’t hit the target. We have dominated the game but we have not controlled it.

“We should have dealt with the last five minutes better. We defended poorly at times today and it cost us. Sometimes you do not find that end product and that happened today. We did not test their keeper enough. It cost us dearly today.”

Palace soaked up pressure in the opening stages and Ayew scored in the 32nd minute as Jeffrey Schlupp headed on goalkeeper Vicente Guaita’s punt upfield and the Ghanaian striker steered a low shot past De Gea after taking the ball in his stride.

With Pogba missing a penalty in Monday’s 1-1 draw at Wolverhampton Wanderers, Rashford stepped up after Luka Milivojevic tripped Scott McTominay and failed to score despite sending Guaita the wrong way.

Wales winger James, who scored on his debut in the 4-0 home win over Chelsea, equalised when he curled a delightful shot into the top corner after the home side’s solitary flowing move of the afternoon.

With the Stretford End roaring United on, they threw men forward hoping to turn the match on its head but slack defending cost them dear again.

Pogba failed to collect a loose ball after Wilfried Zaha’s run and Van Aanholt pounced to beat De Gea with a stinging low shot from 12 metres.

“There is a first time for everything,” Van Aanholt said, referring to his team’s first win at Old Trafford since 1989.

“I think we played really well. I think we deserved the three points. We dug in and luck was on our side today.

“I was gutted when that Manchester United goal went in. We had worked so hard to get the clean sheet but I am delighted that we could counter and get them back.”
