Parliament Sectt staffer accuses Mahara of rape

Kathmandu, September 30

A Parliament Secretariat staffer told lawmaker Uma Regmi early morning today that she was raped by Speaker Krishna Bahadur Mahara last evening at her rented flat in Tinkune. Mahara, however, refuted the allegation. Nepali Congress lawmaker Regmi told THT over phone from Chitwan that the staffer told her about the incident at around 12:30am today.

Regmi said she did not know anything else about the allegation. “What she told me around midnight may be true or false. I do not know,” Regmi said.

Mahara said the accuser was trying to exact revenge for not helping her become a permanent employee at the Parliament Secretariat. “She has been working on deputation at the Parliament Secretariat. She sought my help to make her post a permanent one so that she could work without having to worry about getting transferred from the Parliament Secretariat. I told her that I cannot help her in that regard. She was angry with me for that and levelled the allegation of rape against me,” Mahara said. He claimed that he did not meet her yesterday.

The accuser, whose identity THT knows but chose not to disclose, could not be contacted as her mobile phone was switched off.

A police source told THT that a Parliament Secretariat staffer called last night alleging that she was sexually abused by Mahara, but did not lodge a first information report. Another source at Metropolitan Police Circle, Baneswhor circle, told THT that a Parliament Secretariat staffer told cops that she was sexually abused by a VIP. But when she was asked to lodge an FIR in writing she refused to do so.

Bid to attack Minendra Rijal of NC

Kathmandu, September 29

Armed with khukuris, spears, sticks, beer bottles and stones, cadres of ruling Nepal Communist Party today allegedly attempted to attack Nepali Congress lawmaker Minendra Rijal while he was on his way to Tanahun’s Rising Rural Municipality.

Rijal was on the way to Rising to lay the foundation stone of a rural municipality building, but NCP cadres obstructed his way felling trees all along. Rijal was stuck on the road for more than three hours before local NC cadres assembled and cleared the way. NCP cadres argued that their party was opposed to the proposed site for building construction.

Rijal condemned the attack, saying, “This shows if democracy faces any danger, it’s from the government.” He told THT that the rural municipality had unanimously decided on the site for building construction.  Immediately after the incident, senior NC leader Ramchandra Paudel condemned it, saying NCP cadres presented themselves as ‘mandales’ (nickname given to Panchayat supporters). “Abusing power, NCP cadres are attacking the people’s right to expression, exhibiting their fascist character,” said Paudel issuing a statement.

Recalling the recent attack on septuagenarian NC leader Kiran Koirala who had her hand fractured, Paudel warned that the NC would intensify nation-wide protests to protect democracy if the NCP did not stop promoting such activities inspired by ‘mandales’.

The NC termed the incident ‘premeditated’. The party said although police were informed about the event, they did not act as expected. “The authoritarian characteristic of NCP cadres, who do not accept different views, is condemnable,” said the NC in a statement.

It added that these were attacks on people’s freedom of expression. “The NC will be forced to intensify protests against the authoritarian government if it does not act to control such activities,” it said.

NCP General Secretary Bishnu Paudel said he was gathering information about the incident, and that he would be able to make a statement only after getting detailed information.

NCP Spokesperson Narayan Kaji Shrestha also said he did not have any information about the incident, but added that his party would never attack a responsible leader of the main opposition Nepali Congress. “Who were involved in the incident should be investigated and brought to book. But I want to make it clear, the NCP cadres cannot be involved in such incidents,” Shrestha told THT.

NCRC expedites children rescue operation

National Child Rights Council has intensified its rescue operation in Kathmandu.

According to NCRC, 98 street children were rescued from various places of Kathmandu in the last nine days.

The NCRC has stepped up operation to rescue street-children in a bid to meet the government’s aim of making Kathmandu a street-children-free city. Last Wednesday, it rescued 45 street children (30 boys and 15 girls) from various places such as Ratnapark, New Road, Basantapur, Jaisi Dewal, Thamel, Durbarmarg and Pulchowk.

NCRC is carrying out the rescue operation in coordination with Nepal Police, Children Search Coordination Centre and various other organisations such as Child Workers in Nepal Concerned Centre. NCRC has also claimed that it has rescued 140 street children in the current fiscal year. Children aged between four and 18 were rescued during the period, according to NCRC officials.

All the rescued street children have been sent to various child care centres.   As per the data with NCRC and CSCC,  there are around 300 street children inside the valley.

Police Inspector Mohan Bikram Dahal, also a head of CSCC, said, “If we keep on rescuing street children in the current rate, we will be able to rescue all street children within a few months.”

Dahal, however, stressed the need to find the root cause behind abandonment of these children. He said most of these children ended up on the streets after running away from their houses due to family conflicts triggered mainly by poverty.

“If we fail to address the root cause of the problem, children will continue to end up on the streets,” Dahal said.

The NCRC also said they had inspected and monitored around 100 child care centres since mid-July and rescued over 200 children from five illegal child care centres that were operating without fulfilling the basic criteria.

Administrative Chief at NCRC Krishna Prasad Bushal said, “We found that five out of 100 child care centres were operated illegally, which meant that there could be more such centres,” adding, “All illegally operating centres and centres that do not meet basic standards will be closed soon.”

Judgment execution dismal

Accumulated prison sentence 103,842 years, fines to be collected Rs 11.89bn

Although the judiciary has launched special campaign to enforce judgments, particularly to nab absconding convicts and
collect fines from judgment debtors, the efforts haven’t amounted to much.

Data from Judgment Enforcement Directorate reveals that the total years of prison sentences to be served by convicts accumulated to 103,842 years and total amount of fines to be collected from them amounted to Rs 11.89 billion till mid-July when the last fiscal ended.

There are 124,048 absconding convicts of which 1,666 are foreigners.

According to JED Director Shiva Kumar Pokharel, in the fiscal year that ended in mid-July 2018, nabbed absconding offenders served 20.28 per cent jail term and judgment debtors paid 17 per cent fines. These figures improved slightly in the fiscal that ended in mid-July 2019, with arrested absconding convicts serving 33.5 per cent jail term and collection of fines from judgment debtors rising to 24.79 per cent.

“The country can build a small hydel project if it collects all the fines that judgment debtors owe,” Pokharel argued.

As per Rule 97 of the District Court Regulations, courts can  write to service provider offices, including local levels and police offices, telling them to bar services to absconding convicts and judgment debtors, but the courts have failed to implement this provision effectively.

JED Director Pokharel said if district administration offices refused to issue citizenship certificates and passports to judgment debtors and absconding convicts, that could go a long way in executing court judgments.

According to Pokharel, manual record keeping of judgment debtors and absconding convicts was obstructing implementation of court verdicts. He said his office would soon prepare digital data of absconding convicts and judgment debtors, which would help the office execute judgment.

Senior Advocate Satish Krishna Kharel said it was almost impossible to arrest absconding foreign offenders due to complicated legal procedures. He held Nepal’s faulty penal system responsible for accumulation of fines.

“In financial crimes and less serious crimes, the penal system should first aim to provide reparation to victims, but our system focuses on fines. Judgment debtors should be made to pay reparation to victims of financial and less serious crimes first, then the fines. Victims can always follow up on collecting reparation,” he said and added that government bodies were following due process while collecting fines.

A lawyer preferring anonymity, said that court officials blundered while granting bail to defendants against cheap collateral and this had led to accumulation of fines. “Land plots that defendants mortgage for getting bail are very cheap. The court cannot recover fines imposed on a particular defendant even if it auctions the land,” the lawyer said.

Chairman of Constitutional Lawyers Forum Raju Prasad Chapagai said lack of coordination between the offices concerned had also led to the JED’s failure to execute court judgments.

“Justice sector coordination committees that exist in all tiers of the court and the OAG should play proactive role to enforce judgment,” he said.

The judiciary has launched a special campaign in 24 districts, including most Tarai districts, to expedite judgment where the years of jail sentences to be served by convicts and the amount of fines to be collected from judgment debtors are high.

JED launched special campaign to execute judgments on 18 October 2014 in 16 districts in the first phase. The campaign was then extended to eight more districts on 15 December 2016.

DoTM bans heavy-duty vehicles from entering or leaving valley

Kathmandu, September 27

The Department of Transport Management has banned cargo trucks and lorries from entering or leaving Kathmandu valley with effect from Sunday in order to ease traffic congestion during Dashain.

An urgent public notice published by the DoTM today said that no 10-wheeler or multi-axle trailer trucks carrying goods other than drugs and essential commodities would be allowed to ply the roads inside Kathmandu from September 29 to October 5. The DoTM informed that a decision to this effect was made to reduce the traffic jam on the highways and ensure safety and comfort of people going back to their hometowns. This rule will be applicable for the heavy duty vehicles from Narayanghat to Kathmandu.

Metropolitan Traffic Police Division said it would strictly implement the decision of the DoTM, the regulating body responsible for overall management of road transport service in the country. The heavy duty vehicles are one of the causes of traffic jam on the congested two-lane highway due to their slower dynamics.

Meanwhile, MTPD said that it had made special security arrangements to prevent road accidents during Dashain, Tihar and Chhath. Senior Superintendent of Police Bhim Prasad Dhakal, MTPD in-charge, informed that police in uniform and plain clothes equipped with breathalysers were deployed at all entry points to Kathmandu valley to prevent drunk driving.

Traffic police have started conducting regular and surprise alcohol meter test on drivers, with major focus on long-route buses as people have already started leaving the valley for their home villages and towns to cerebrate Dashain. Passenger help desks have been set up in 14 places of the valley to enforce traffic rules, besides facilitating travellers and taking action against crooked transport entrepreneurs. Traffic offences increase during the festive season. According to MTPD, around 2.5 people were expected to leave the valley to celebrate Dashain.

Traffic police officials said the help desks were set up to assist people in booking and acquiring travel tickets, given the tickets were not sold out. Ticket booking counters have been asked to display bus fares to ensure transparency. Help desks will also warn ticket booking clerks against possible incidents of double-ticketing, blackmailing, overcharging and selling tickets in black. Officials deployed at help desks will arrest and take action against those involved in fraudulent activities. MTPD has appealed to all to lodge complaints at the help desks if they face any problems.

For the safety of the commuters, the exiting law requires the transporter entrepreneurs to have two drivers in each vehicle that ply the routes longer than 250 km to prevent road accidents due to exhaustion. SSP Dhakal said this rule would be implemented in an effective manner.

Conflict victims blast political leadership

Conflict victims today blasted political leadership for neglecting those who sacrificed everything to bring about political transformation in the country.

They also warned of another rebellion if political parties and their leaders did not reform themselves and address concerns of victims of the 10-year Maoist insurgency at the earliest.

Bhavana Bidhrohi, a former Maoist rebel, said they sacrificed their lives to ensure political transformation in the country only to lead miserable lives. “Monarchy was overthrown and a republic system was established. But what have we got?” asked Bidrohi, who stood at the podium with the help of crutches. “We have been robbed of everything and rendered disabled.”

Speaking at an interaction in Kathmandu in the presence of Nepal Communist Party (NCP) Chairperson Pushpa Kamal Dahal, senior NCP leader Madhav Kumar Nepal and Nepali Congress President Sher Bahadur Deuba, Bidrohi accused Dahal of undermining their sacrifices.

“You shook hands with Deuba, who once ordered to kill us, to remain in power,” said Bidrohi, referring to Dahal as ‘bua’ (father) because she devoted her life to the Maoist rebellion led by Dahal.

Bidrohi warned that those victimised by both the state and Maoists would come together and launch a decisive protest if denied justice. “We are only seeking justice, nothing else” she said.

Ram Kumar Bhandari, founder of National Network of the Families of the Disappeared and Missing in Nepal, accused the political leadership of living a luxurious life undermining sacrifices of those who were killed, disappeared and rendered disabled during the conflict.

“Political leadership has become dishonest and the state unaccountable,” he said, adding they wanted to know the whereabouts of those who disappeared during the conflict.

Former chairperson of Conflict Victims Common Platform Suman Adhikari said leaders were trying to find solution to transitional justice without involving conflict victims. He said parties were trying to appoint their near and dear ones in transitional justice mechanisms that have remained vacant since April.

“The Truth and Reconciliation Commission and the Commission on Investigation of Enforced Disappeared Persons failed because of politicking and the commissioners’ incompetence, besides lack of necessary legislation,” said Adhikari, demanding that appointments be made only after amending the act.

Rita Karki, a member of conflict-affected families of security personnel, said the government should listen to those victimised by Maoists and the state.

The victims also demanded that issues related to child soldiers and ineligible soldiers be addressed giving due priority.

NCP, CPC establish fraternal ties

Nepal Communist Party (NCP) and Communist Party of China today established fraternal relations with the signing of a memorandum of understanding here today.

The MoU was signed on the sidelines of the ongoing two-day ‘Communist Party of China’s Opinion about Xi Jinping Thought and Ideological Discussion between Nepal Communist Party and Communist Party of China’ that kicked off here yesterday.

The NCP’s International Department Chief Madhav Kumar Nepal and the CPC’s International Liaison Department’s Director Song Tao signed the MoU in the presence of Prime Minister KP Sharma Oli and NCP Co-chairperson Pushpa Kamal Dahal. Song is in Nepal to take part in the discussion.

As per the six-point MoU, the two parties will facilitate exchange of high-level visits between the two countries. The two parties will increase frequency of visits at the worker-level for training in the two countries. The parties will also boost cooperation in terms of experience sharing and expand exchange of visits of youths and local-level leaders.

The two parties will also work to boost relations at the people’s level—intelligentsia, civil society organisations and mediapersons — from both the countries. They will also run annual joint programmes on thoughts and ideology.

NCP International Department Deputy Chief Bishnu Rijal said the MoU was signed to renew relations between the two communist parties, especially after the unification of the then CPN-UML and CPN-MC. Before the integration, the CPC had separate relations with the CPN-UML and CPN-MC.

“It is an attempt to further consolidate the relations existing between the two countries and two parties, and take such relations to a new height,” Rijal said. “Nepal and NCP are committed to the ‘One China Policy’ and we are moving ahead as per the same commitment.”

The discussion programme, which ends today, is being jointly organised by the NCP’s School, Organisation and International departments, and the CPC’s Central Party School, Organisation Department and International Liaison Department.

Around 200 participants from the NCP and 40 from CPC are taking part in the event that mostly dwells on ‘Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era’.

Pelosi orders impeachment probe: ‘No one is above the law’

WASHINGTON: House Speaker Nancy Pelosi launched a formal impeachment inquiry against US President Donald Trump on Tuesday, yielding to mounting pressure from fellow Democrats and plunging a deeply divided nation into an election-year clash between Congress and the commander in chief.

The probe focuses partly on whether Trump abused his presidential powers and sought help from a foreign government to undermine Democratic foe Joe Biden and help his own reelection. Pelosi said such actions would mark a “betrayal of his oath of office” and declared, “No one is above the law.”

The impeachment inquiry, after months of investigations by House Democrats of the Trump administration, sets up the party’s most direct and consequential confrontation with the president, injects deep uncertainty into the 2020 election campaign and tests anew the nation’s constitutional system of checks and balances.

Trump, who thrives on combat, has all but dared Democrats to take this step, confident that the specter of impeachment led by the opposition party will bolster rather than diminish his political support.

Meeting with world leaders at the United Nations, he previewed his defence in an all-caps tweet: “PRESIDENTIAL HARASSMENT!”

Pelosi’s brief statement, delivered without dramatic flourish but in the framework of a constitutional crisis, capped a frenetic weeklong stretch on Capitol Hill as details of a classified whistleblower complaint about Trump burst into the open and momentum shifted toward an impeachment probe.

For months, the Democratic leader has tried calming the push for impeachment, saying the House must investigate the facts and let the public decide. The new drive was led by a group of moderate Democratic lawmakers from political swing districts, many of them with national security backgrounds and serving in Congress for the first time. The freshmen, who largely represent districts previously held by Republicans where Trump is popular, risk their own reelections but say they could no longer stand idle. Amplifying their call were longtime leaders, including Rep. John Lewis of Georgia, the civil rights icon often considered the conscience of House Democrats.

“Now is the time to act,” said Lewis, in an address to the House. “To delay or to do otherwise would betray the foundation of our democracy.”

At issue are Trump’s actions with Ukraine. In a summer phone call with Ukrainian President Volodymyr Zelenskiy, he is said to have asked for help investigating former Vice President Biden and his son Hunter. In the days before the call, Trump ordered advisers to freeze $400 million in military aid for Ukraine — prompting speculation that he was holding out the money as leverage for information on the Bidens. Trump has denied that charge, but acknowledged he blocked the funds, later released.

Biden said Tuesday, before Pelosi’s announcement, that if Trump doesn’t cooperate with lawmakers’ demands for documents and testimony in its investigations the president “will leave Congress … with no choice but to initiate impeachment.” He said that would be a tragedy of Trump’s “own making.”

The Trump-Ukraine phone call is part of the whistleblower’s complaint, though the administration has blocked Congress from getting other details of the report, citing presidential privilege. Trump has authorized the release of a transcript of the call, which is to be made public Wednesday.

“You will see it was a very friendly and totally appropriate call,” Trump said.

The whistleblower’s complaint was being reviewed for classified material and could go to Congress by Thursday, according to a person familiar with the issue who was not authorized to discuss it publicly and spoke on condition of anonymity.

Trump has sought to implicate Biden and his son in the kind of corruption that has long plagued Ukraine. Hunter Biden served on the board of a Ukrainian gas company at the same time his father was leading the Obama administration’s diplomatic dealings with Kyiv. Though the timing raised concerns among anti-corruption advocates, there has been no evidence of wrongdoing by either the former vice president or his son.

While the possibility of impeachment has hung over Trump for many months, the likelihood of a probe had faded after special counsel Robert Mueller’s Trump-Russia investigation ended without a clear directive for lawmakers.

Since then, the House committees have revisited aspects of the Mueller probe while also launching new inquiries into Trump’s businesses and various administration scandals that all seemed likely to drag on for months.

But details of Trump’s dealings with Ukraine prompted Democrats to quickly shift course. By the time Pelosi addressed the nation Tuesday, about two-thirds of House Democrats had announced moving toward impeachment probes.

The burden will likely now shift to Democrats to make the case to a scandal-weary public. In a highly polarized Congress, an impeachment inquiry could simply showcase how clearly two sides can disagree when shown the same evidence rather than approach consensus.

Building toward this moment, the president has repeatedly been stonewalling requests for documents and witness interviews in the variety of ongoing investigations.

After Pelosi’s Tuesday announcement, the president and his campaign team quickly released a series of tweets attacking Democrats, including a video of presidential critics like the speaker and Rep. Ilhan Omar discussing impeachment. It concluded: “While Democrats ‘Sole Focus’ is fighting Trump, President Trump is fighting for you.”

Senate Majority Leader Mitch McConnell said Pelosi’s well-known “efforts to restrain her far-left conference have finally crumbled.”

Pelosi has for months resisted calls for impeachment from her restive caucus, warning that it would backfire against the party unless there was a groundswell of public support. That groundswell hasn’t occurred, but some of the more centrist lawmakers are facing new pressure back home for not having acted on impeachment.

While Pelosi’s announcement adds weight to the work being done on the oversight committees, the next steps are likely to resemble the past several months of hearings and legal battles — except with the possibility of actual impeachment votes.

On Wednesday, the House is expected to consider a symbolic but still notable resolution insisting the Trump administration turn over to Congress the whistleblower’s complaint. The Senate, in a rare bipartisan moment, approved a similar resolution Tuesday.

The lawyer for the whistleblower, who is still anonymous, released a statement saying he had asked Trump’s director of national intelligence to turn over the complaint to House committees and asking guidance to permit the whistleblower to meet with lawmakers.

Pelosi suggested that this new episode — examining whether a president abused his power for personal political gain — would be easier to explain to Americans than some of the issues that arose during the Mueller investigation and other congressional probes.

The speaker put the matter in stark terms: “The actions of the Trump presidency revealed dishonorable facts of the president’s betrayal of his oath of office, betrayal of his national security and betrayal of the integrity of our elections.”
